Typically, when a patent attorney drafts patent claims, he/she has the difficult task of both encapsulating the invention in the best way—to ensure the broadest protection for the client—and taking care of the formalities involved in claims drafting to ensure compliance with the appropriate regulations.

Claims drafting guidelines include specifications for consecutive claims numbering, appropriate dependency logic, antecedent basis for used terms, etc. Claims that do not comply with these guidelines may result, in extreme cases, in an unenforceable patent. Checking claims for correctness is a tedious and lengthy process, especially when tens (and sometimes hundreds) of claims are involved in a single patent document.

Using a proprietary artificial intelligence algorithm, iClaim Check scans each claim individually and studies the inter-relationship between claims, to determine where errors have been made. The iClaim Check analysis uses an expert system to determine each claim’s type and derives dependency rules from the determined type. Claims are also checked for missing antecedent basis and for typographical errors such as missing period at the end of the claim, claim not starting with a capital letter, etc.

Operation of iClaim starts upon highlighting (choosing) the claims text in Word, clicking the right mouse button and picking the iClaim Check command from the menu. When the analysis is done, the MS Word Comments tool is used by iClaim software to highlight errors and provide a brief explanation as to the nature of the error.

When applicable, suggested corrective measures are indicated. Thus, the patent attorney may use iClaim in the natural environment in which the patent is drafted—without need to operate a different program.

In addition, iClaim Renumber performs automatic renumbering of claims and dependencies. A separate menu item of the right mouse click launches iClaim Renumber. The user selects the claims to be renumbered and specifies an increment (a positive or negative number) to be applied to the selected claims. The program determines whether the Automatic Numbering tool of Word had been used and selectively corrects all the requested claim numbers and the associated dependencies accordingly.

iClaim can be used for both US and EP patent claims. It is efficient and has a small footprint. It can be used on any PC using a Windows 98/2000/XP/Vista operating system. iClaim is a valuable personal tool recommended for every patent attorney’s desktop.
